IMPORTANT UPDATE REGARDING THE TRANSMISSION OF DATA PROTECTION TO USA WHICH ARE BASED ON SAFE HARBOUR PRINCIPLES

Ban of personal data transmission to the US by the greek DPA: The Greek DPA has uploaded on the 21-10-2015 an announcement regarding the transmissions of personal data to the US. According to this announcement further to the ECJ decision of 6-10-2015, transmission of personal data to the US on the basis of Safe Harbour principles is no longer legal. Therefore the greek DPA calls all Controllers to stop hereinafter any data transmission to the US which is made on the legal basis of Safe Harbour. WP29 is expected to study the impact of the above decision of the ECJ on all the instruments that have been laid down by the Community and national legislation in force for the transmission of data outside the E.U. In the meantime, the Data Protection Authorities of the EU consider that Standard Contractual Clauses and Binding Corporate Rules can still be used as legal instruments for those transmissions.
Finally the Greek DPA reminds that it has in any case the power to check if the transmission of data to countries outside the EU complies with the conditions of the community and national law and to prohibit any transmission that is contrary to them.
